Policies
EONET shall not be held liable or responsible for and shall be saved and held harmless by customer from and against any and all claims and damages of every kind, for injury to any person or persons and for damage to or loss of any type of property, arising out of or attributed, directly or indirectly, to the operations or performances of EONET in providing goods and services to customer under the terms of this agreement.
Customer understands that EONET cannot control what is available on the internet. The internet allows access to obscene, pornographic, and sexually explicit materials and information. Customer agrees to hold harmless EONET from any claims, demands, causes of action or complaints for the fact that customer and/or family and friends may be able to access these types of materials and information.
Customer will hold harmless EONET for any computer viruses encountered by customer during use of EONET services.
Customer also will hold harmless EONET for any liability for damage which may be caused as a result of software downloads being utilized by customer as well as any data loss, e-mail loss or damage to any software or hardware on customer's computer as a result of use of the services provided by EONET. Service disruptions and interruptions can originate anywhere along the data path from your computer to the system you are obtaining information from or sending information to. There are an equal or greater amount of things beyond your setup that can cause connection and data transmission problems. EONET, like you, has no control past the telephone company's demarcation point.
During the service that EONET provides, the network may experience down times which may occur through no fault or involvement of EONET. Customer will hold EONET harmless from any such down time events that are not caused by any intentional or negligent acts of EONET. Situations that may occur at EONET include but are not limited to system maintenance, network upgrades, component failures, power outages, LEC performance and maintenance, etc.
EONET provides no warranty or other guarantee that our system will interface and make proper connections with the customer's computer system.
Disclaimer of Implied Warranty of Merchantability and Fitness
EONET disclaims any warranty of merchantability or fitness for any particular purpose whatsoever with respect to the goods and services being sold under this agreement.
Disclaimer of All Implied Warranties
The goods and services described in this agreement are sold on "as is" basis and EONET disclaims any implied warranties with respect to the goods and services.
Reserved Rights
EONET reserves the right to refuse service to anyone at any time for any reason.
Acceptable Use Policy
The Internet is an excellent way to send, receive, and find information. Some people use the Internet for enjoyment; as a form of entertainment. This can come about in numerous ways, with the most typical being general 'web surfing', chat services, newsgroups, e-mail, and file transfers. Your right to entertainment on or use of the Internet ends when it inhibits another user to do the same.
EONET prohibits material that is grossly offensive to the community, including clear expressions of bigotry, racism, or hatred. EONET bars information that is obscene, threatening, harassing, libelous, hateful, or in any way a violation of intellectual property laws.
EONET prohibits any user from engaging in any activity that violates the policies of any network they access as well as any activities that violate any state or federal laws.
EONET prohibits any user from transmitting or receiving pirated software. Users are forbidden to engage in newsgroup spamming as well as sending mass junk e-mail or mail bombing. Users may not use EONET to solicit for illegal pyramid schemes in any way. Sending unsolicited mass mail messages, including, without limitation, commercial advertising or informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of that site.
EONET users may not share their account information with anyone else. They may not login to EONET more than once at any time, unless a multi-user service agreement is in effect between the customer and EONET.
